HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY W.P. No. 17055 OF 2016 ORDER :

This writ petition is filed aggrieved by the action of the respondents 2 and 3 in conducting the survey of petitioners land i.e., Ac.0.44 cents in R.S.No.41, situated in Samanthakurru village, proclaiming to remove the existing coconut trees therein without issuing any notice.

Heard learned counsel for the petitioner and learned Government Pleader for Revenue.

Learned counsel for the petitioner submits that without issuing any notice, the respondents are trying to evict the petitioner from the subject land in R.S.No.41, situated at Samanthakurru village. Learned Assistant Government Pleader for Revenue on instructions, submits that there are several encroachers in the same survey number and all are issued notices under Section 7 of the A.P. Land Encroachment Act, 1905 and that the petitioner is also an encroacher and steps are being taken to issue notice to the petitioner also.

In the circumstances, Status quo obtaining as on today shall be maintained. However, this order will not preclude the competent authority from issuing notice to the petitioner and take action following the procedure under Land Encroachment Act, for evicting the petitioner.

With the above direction, this writ petition is disposed of. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in this writ petition shall stand dismissed.
