THE HONOURABLE Dr.JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.13890 of 2016 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C by the petitioner/accused in Crime No.193 of 2016 of Burgampahad Police Station, Khammam District, registered for the offences punishable under Sections 498-A, 494, 495 and 506 IPC and Sections 3 and 4 of the Dowry Prohibition Act, on the report of the petitioner's first wife, who is no other than the 2nd respondent/de facto complainant to quash the proceedings.

Heard and perused the material on record. The facts fall short for this Court to admit or to quash the investigation, but for to say the petitioner being a public servant and disputes the very entering of the alleged second marriage, which is part of the investigation and at the nasal stage being entitled to the concession of bail. Accordingly, the criminal petition is disposed of giving liberty to the petitioner/accused to surrender before the learned Magistrate concerned and move for regular bail under Section 437 Cr.P.C, with notice to learned Assistant Public Prosecutor concerned and in such an event, the learned Magistrate shall grant bail with necessary conditions on the same day or at least on the next day, but for to say that he shall not be in judicial custody beyond 48 days. As a sequel, miscellaneous petitions, if any, pending in the petition shall stand closed.
