O R D E R
The prayer of the petitioner in this case is as under: "For the reasons stated in the accompanying affidavit, it is therefore prayed that this Hon'ble Court may be pleased to issue a writ order or direction one in the nature of Writ of Mandamus declaring the action of 4th respondent in conducting the auction of sand quarry lease hold rights vide notification No.469/SAND/2016 dated 21-01-2016 in Cheruvukindapalli, Vallur Mandal, Y.S.R. Kadapa District as arbitrary, illegal, unjust and in violation of Mines and Minerals (Development & Regulation) Act 1957 and A.P. Minor Mineral Concession Rules 1966, and consequently set aside the notice No.145/SM/2016 dated 01-02-2016 for cancellation of allotment in respect of Cheruvukindapalli sand reaches of Valluru Mandal, Y.S.R.
District and further direct the respondents to permit the petitioner society to extract the sand allotted in R.C.No.4064/DRDA/SM/2014 dated 1311-2015 and pass such order or orders that the Honourable Court may deem fit and proper in the interest of justice." Learned Assistant Government Pleader for Mines and Geology states that in the light of the changed sand policy of the State, proposed auctions for grant of sand mining rights stand cancelled. In that view of the matter, this writ petition does not survive for consideration on merits and is accordingly dismissed. Pending miscellaneous petitions, if any, shall stand dismissed in the light of this final order. No order as to costs.
