HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.4781 of 2019 ORDER:

The prayer of the petitioner in this case reads as under:- "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus declaring the action of the 2nd respondent herein in keeping the appeal bearing File No.Memo/3061/G1/2017 in abeyance without passing any orders from 2017 onwards to till date even though the government has deleted the schedule property from the 22-A prohibitory property list vide Letter No.E4/3873/2005 Dated 24.03.2016 as illegal, arbitrary, unconstitutional and against the principles of natural justice fair play and in violation of Articles 14, 21 and 300A of the Constitution of India and to pass such other order or orders as this Honourable Court may deem fit and proper in the facts and circumstances of the case."

Sri D.Amarender Reddy, learned counsel for the petitioner, states that the petitioner preferred an appeal against the refusal order dated 24.6.2002 of the Sub-Registrar, Champapet, and the said appeal is kept pending unnecessarily despite the Government denotifying the subject land from the list of prohibited properties under letter dated 24.3.2016.

It is not open to the District Registrar, Ranga Reddy District, to keep pending the statutory appeal preferred before him indefinitely. All the more so, when the issue already stands settled by virtue of the later development. The Writ Petition is accordingly disposed of directing the District Registrar, Ranga Reddy District, to take up the petitioner's appeal in File No.3061/G1/2017 and dispose of the same on merits and in accordance with law expeditiously and

SK, J WP.No.4781 of 2019 Dt:08.3.2019 in any event, not later than two weeks from the date of receipt of a copy of this order, be it from whatever source.
