THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 3950 of 2018 O R D E R:
Challenging the Special Notice, dated 02.02.2018, issued by respondent No.2-Penukonda Gram Panchayat, Anantapuramu District, the present writ petition is filed. Learned counsel for the petitioner contends that the petitioner is unable to submit her explanation pursuant to the impugned notice, which is vague.
Learned Standing Counsel for respondent No.2 points out that the petitioner was granted permission for construction of ground + first floor, whereas she constructed four floors in violation of the sanctioned plan. He submits that the impugned notice is not vague in any manner as the word 'multi-storied' would indicate that the petitioner had constructed more than the permitted limit.
In the light of the above submission, this Court cannot accept the contention of the learned counsel for the petitioner that the impugned notice is vague.
In those circumstances, the writ petition is disposed of giving liberty to the petitioner to submit her explanation to the impugned notice within three weeks from today. Thereupon,
respondent No.2 shall consider the same and pass appropriate orders, in accordance with law. Pending passing of such orders, no coercive steps shall be taken against the petitioner with respect to the construction.
