THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE DR JUSTICE SHAMEEM AKTHER WRIT APPEAL NO.358 OF 2010 JUDGMENT: {Per the Hon'ble the Acting Chief Justice Ramesh Ranganathan} This appeal, under Clause 15 of the Letters Patent, is preferred against the orders passed by the learned Single Judge in WV.MP.No.4318 of 2008 and WP.MP.No.34276 of 2009 in WP.No.26331 of 2009 dated 01.02.2010 vacating the earlier order of status quo passed on 03.12.2009 on the ground that possession of the subject land has already been taken by the Temple. While admitting the appeal on 12.05.2009, notice was ordered in WA.MP.No.794 of 2010. The appellants-writ petitioners have not had the benefit of any interim order for the past more than seven years. We see no reason, at this stage, to consider the validity of the interlocutory order under appeal vacating the earlier order of status quo. Suffice if, instead, the Writ Petition itself is finally heard.
The Writ Appeal is disposed of, accordingly, leaving it open to the petitioners to request the learned Single Judge for an early hearing of the Writ Petition. There shall be no order as to costs.
