HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.5571 of 2015 ORDER:

Heard the learned counsel appearing for the petitioner and the learned Government Pleader for Civil Supplies.

2. This writ petition is filed seeking writ of Mandamus declaring the action of the 2nd respondent in not disposing of the 6-A case registered under the Essential Commodities Act against the petitioner, as illegal and arbitrary.

3. Earlier, this Court by order dated 18.04.2013 specifically directed the 1st respondent - Collector (Civil Supplies Wing), Kakinada, East Godavari District, in WP No.11755 of 2013 to dispose of the proceedings under Section 6-A of the Act within a period of two months from the date of receipt of a copy of this order. But so far, the District Collector (Civil Supplies) has not disposed of the proceedings under Section 6-A of the Act, which led to filing of the present writ petition.

4. Under these circumstances, the writ petition is disposed of directing the 2nd respondent to dispose of the 6-A of the proceedings and pass appropriate orders regarding the seized stock within a period of four weeks from the date of receipt of a copy of this order. The petitioner is at liberty to file interim relief petition before the 2nd respondent for release of the stock and the same shall be disposed of in accordance with law by the 2nd respondent, within a period of one week from the date of making of such application.
