THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.3951 of 2018 ORDER:

The petitioner states that he is the absolute owner, possessor and enjoyer of the land of an extent of Ac.4.31 guntas in Survey No.62/3 situated at Vadlagudem Revenue Village, Mustibanda Gram Panchayat, Dammapeta Mandal, Badradri Kothagudem District. The said land was originally assigned in his favour on 02.03.1959 under the provisions of the Laoni Rules by the fourth respondent. He states that he leased out the said land to the fifth respondent in the year 2012 and the fifth respondent belongs to a Forward Community and a retired Government servant. The fifth respondent paid the rent for some time and later stopped. When arrears of rent was demanded, the fifth respondent attacked the petitioner and prevented him from entering his land.

When the petitioner verified the revenue records he came to know that the fifth respondent obtained pattadar pass books for the said land by misrepresenting the facts on the basis of fake documents. In those circumstances, the petitioner filed a representation on 07.06.2013 asking the fourth respondent to give the information with regard to the circumstances under which the revenue records were changed. The fourth respondent did not give any copy of the documents and in those circumstances, he submitted a representation on 06.01.2014 requesting the fourth respondent to enquire into the matter.

conducted, the petitioner submitted another representation on 14.11.2017 through registered post under Sections 3 and 4 of the Andhra Pradesh Assigned Lands (Prohibition of Transfers) Act, 1977. When no action was taken on the said representation, the present Writ Petition is filed. In view of the nature of disposal of the present Writ Petition, notice to the fifth respondent is dispensed with. Since the grievance of the petitioner relates to the change of entries in the revenue records without issuing any notice to him, the petitioner can file an appropriate application under the provisions of the Telangana Rights in Land and Pattadar Pass Books Act and as and when such application is filed, it is needless to observe that the fourth respondent shall consider the same, issue appropriate notice to the petitioner as well as the fifth respondent and pass appropriate orders in accordance with law.
