HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:
Petitioner claims to be the owner of LMV vehicle bearing Registration No.AP-28-BY-7253. This vehicle was detained on the allegation of drunken driving and not carrying the relevant documents in proof of ownership. Petitioner alleges that illegally the vehicle was detained and was not released to the petitioner and that the respondents cannot keep the vehicle with them and the same amounts to illegal exercise of power.

As per the written instructions furnished to the learned Government Pleader, apparently the vehicle is not deposited with XI Metropolitan Magistrate Court at Kukatpally, where charge sheet is filed on a petty case of driving the vehicle in intoxicated condition and not carrying the relevant documents, and the vehicle is still in the custody of Station House Officer, Madhapur Traffic Police Station, Cyberabad, and it is stated that vehicle will be released if the original documents are produced.

Having regard to the same, subject to petitioner appearing before the Inspector of Police, Madhapur Traffic Police Station on 12.03.2019 at 11.00 a.m., with relevant documents in proof of ownership of the subject vehicle, the Inspector of Police shall consider the same and release the vehicle to the petitioner. Writ Petition is accordingly disposed of. Pending miscellaneous petitions shall stand closed.
