A.V.S.Ram Mohan Rao v. The State Of Telangana
THE HON'BLE SRI JUSTI CE SANJAY KUMAR WRI T PETI TI ON No.4786 of 2019 ORDER:
The prayer of the petitioner in this case reads as under: 'For the reasons set out in the accompanying affidavit, it is humbly prayed that this Hon'ble Court may be pleased to issue an appropriate writ, order or direction more particularly one in the nature of Writ of Mandamus directing the respondents to issue new Dharani Pattedar Pass Books and Title Deeds and issuance of Rythu Bandhu cheques under Rythu Bandhu Scheme in respect of agricultural land admeasuring Ac.39. 22 gnts., in Sy.No.
62/6, 62/7, 62/8, 63/4, 63/5 and 63/6 of Tammaram Village, Chintaplapalem (Mellachervu) Mandal, Suryapet (Nalgonda) District to the petitioner in terms of the fundamental and constitutional rights guaranteed under the Constitution of India and pass such other order or further orders as this Hon'ble Court deem fit, just and proper in the interest of justice, equity and fair play.' Perusal of the record reflects that the petitioner was already issued a regular pattadar pass book and title deed in relation to the subject land under the provisions of the Telangana Rights in Land and Pattadar Pass Books Act, 1971. He made an application as long back as in June, 2018, for issuance of a new pattadar pass book which would entitle him to claim the benefit of the Government's welfare scheme.
It appears that the petitioner also got issued legal notices dated 12.06.2018 and 07.09.2018 to the revenue authorities owing to their alleged inaction upon his application.
It is not open to the Tahsildar, Chintalapalem Mandal, Suryapet District, to remain somnolent upon such an application, having received the same.
The writ petition is accordingly disposed of directing the Tahsildar, Chintalapalem Mandal, Suryapet District, to take appropriate action upon
the petitioner's application for issuance of a new pattadar pass book and title deed in relation to the subject land expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this order, be it from whatever source.
Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs. ____________________ JUSTI CE SANJAY KUMAR Date:08.03.2019 GJ
