HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY TRANSFER CIVIL MISCELLANEOUS PETITION NO.112 OF 2018 ORDER:

This Transfer Civil Miscellaneous Petition, under Section 24 of Code of Civil Procedure 1908, is filed to withdraw F.C.O.P.No.1128 of 2012 pending on the file of Additional Family Court, City Civil Court, Hyderabad to Judge, Family Court, City Civil Court, Hyderabad, on the apprehension that the Presiding Officer may order attachment of salary as the petitioner, being a government employee, disobeyed the orders of the Court virtually. When the Presiding Officer of the Court demanded to pay arrears of maintenance in terms of the orders passed by this Court in CRP.No.3138 of 2015, without any interlocutory order, it is not a ground to withdraw and transfer. However, taking into consideration the facts and circumstances of the case, the Judge, Family Court, City Civil Court, Hyderabad is directed to dispose of the F.C.O.P.No.1128 of 2012, as expeditiously as possible, in any event, not later than six months from today. With the above direction, the Transfer Civil Miscellaneous Petition stands dismissed.
