Sri S.Ganesh Rao, learned counsel for the appellant as well as Sri Sourabh Agarwal, learned counsel representing Sri V.Ravinder Rao, learned counsel for the respondent, would submit that the cause in this appeal does not survive for adjudication as the matter has been settled out of Court and the appeal has become infructuous. 2.

Recording the said submission, the Appeal Suit is dismissed as infructuous. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this appeal shall stand closed.
