This writ petition is filed challenging the order Rc.No.304/16DT, dated 08.12.2016 on the ground that notice is issued to a dead person and the same is invalid. It is submitted by learned counsel for the petitioner that Form1 does not indicate in whose favour alienation took place and it is very vague.
On the other hand, learned Assistant Government Pleader for Revenue produced written instructions stating that the petitioner submitted explanation and also Form-II notice was also issued to the person, who is in possession of the subject land and the impugned order has been passed.
Notice was issued to a dead person and the other aspect is that the notice is very vague and what is nature of violation is also very vague.
In view of aforesaid circumstances, the impugned order is set aside. However, this will not preclude the competent authorities from issuing notice to the petitioner as well as encroachers in accordance with law and take action.
Accordingly, this writ petition is allowed to the extent indicated above. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 14-02-2017 kvs
