Heard learned counsel for the petitioner and learned Government Pleader for Services-I for learned Government Pleader for Panchayat Raj appearing for the respondents. 2.

Petitioner is working as Panchayat Secretary, Grade-III of Bompally Gram Panchayat and aspiring for promotion as Panchayat Secretary, Grade-II. According to petitioner, he crossed 45 years. For promotion to the post of Panchayat Secretary, Grade-II, an employee must pass departmental tests and on the ground that petitioner has not passed departmental tests, he is not considered for promotion. According to petitioner, since he has already crossed 45 years, he is entitled to seek exemption from passing departmental tests, for granting promotion, in accordance with G.O.Ms.No.165, dated 22.04.1997, but the same is not extended to him. Aggrieved by non-consideration of entitlement for promotion, petitioner made a representation on 19.08.2019 to the District Panchayat Officer-2nd respondent. Alleging inaction on the said representation, this writ petition is filed. 3.

Since a representation is already made ventilating the service grievance of petitioner and the same is yet to be acted upon, without expressing any opinion on merits, the Writ Petition is disposed of, directing the 2nd respondent to consider the representation submitted by the petitioner and to take appropriate decision as warranted by law, and communicate the same to the

- 3 - petitioner, within a period of four weeks from the date of receipt of copy of this order. Pending miscellaneous petitions, if any, shall stand closed.
