HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CIVIL MISCELLANEOUS PETITION No.47 of 2014 ORDER:

This petition is filed to withdraw O.P.No.1853 of 2013 from the file of Family Court, Ranga Reddy District at L.B. Nagar and transfer the same to Family Court, Khammam for disposal in accordance with law.

2. Petitioner herein is wife and she filed her affidavit in support of the petition. According to affidavit averments, her marriage with respondent was performed on 17.05.2006 at Yellandu Town in Khammam District and after their marriage, she lead happy marital life with her husband, during which, two children were born and thereafter, respondent/husband started harassing her and neglected her and her children, for which, she went to her parents' house along with children and staying there. She stated that respondent/husband filed O.P for divorce before Family Court, Ranga Reddy only to harass her and she is unable to attend the Court at Ranga Reddy due to financial and health problems. She also contended that respondent is threatening whenever she appeared in Ranga Reddy Court. She further contended that she and her witnesses have danger to their life at Ranga Reddy, and for these reasons, she prayed for transfer of O.P No.1853 of 2013 from Ranga Reddy to Khammam.

3. Respondent/husband has not filed any counter disputing affidavit averments of petitioner.

4. Heard arguments.

5. Considering the reasons stated in the affidavit and also considering the convenience of petitioner/wife, I feel her request for transfer of divorce O.P. from Ranga Reddy Court to Khammam Court can be considered.

8. For these reasons, O.P.No. 1853 of 2013 is withdrawn from the file of Family Court, Ranga Reddy at L.B. Nagar and transferred to Family Court, Khammam for disposal in accordance with law.

9. Accordingly, this Transfer Miscellaneous Petition is allowed. No costs. Miscellaneous Petitions, if any pending, in this petition, shall stand closed.
