This petition is filed under Section 24 of C.P.C. seeking to withdraw O.P.No.208 of 2014 from the file of the Motor Accidents Claims Tribunal-cum-District Judge, Ongole, Prakasam District, and transfer the same to the file of the Motor Accidents Claims Tribunal-cum-III Additional Chief Judge, City Civil Court, Hyderabad, to be tried along with O.P.No.624 of 2014. 2.

Heard the learned counsel for both parties.

A perusal of the record reveals that one Smt. Laxmi Naga Durga died in a motor vehicle accident that occurred on 27.11.2013 near ROB Fly over, High Tech City, Madhapur, Hyderabad. The husband of the deceased filed O.P.No.624 of 2014 on the file of the Motor Accidents Claims Tribunal-cum-III Additional Chief Judge, City Civil Court, Hyderabad, claiming compensation. The parents of the deceased filed O.P.No.208 of 2014 on the file of the Motor Accidents Claims Tribunal-cumDistrict Judge, Ongole, Prakasam District, claiming compensation. Both the petitions arise out of the same accident. 4.

At the time of arguments, the learned counsel for the respondents submitted that the respondents have no objection for transfer of O.P.No.208 of 2014 to the file of the Motor Accidents Claims Tribunal-cum-III Additional Chief Judge, City Civil Court, Hyderabad.

In view of the submission made by the learned counsel for the respondents, this Court is not inclined to go into the merits of the main case.

Having regard to the facts and circumstances of the case and also the submission made by the learned counsel for the respondents, the Transfer Civil Miscellaneous Petition is allowed withdrawing O.P.No.208 of 2014 from the file of the Motor Accidents Claims Tribunal-cum-District Judge, Ongole, Prakasam District, and transferred to the file of the Motor Accidents Claims Tribunal-cum-III Additional Chief Judge, City Civil Court, Hyderabad, to be tried along with O.P.No.624 of 2014 in accordance with law. There shall be no order as to costs. 7.
