HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 21976 of 2007 Order:

This Writ Petition was filed challenging the action of the respondent Bank in trying to take possession of the property of the petitioners bearing No.14-2-30/A in Ward No.8, Block-II, TS-74, Guntur, in exercise of the powers under Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 and the rules made thereunder without serving any notice.

This Court, by order dated 12.10.2007, granted interim stay subject to condition of the petitioners depositing an amount of Rs.1,00,000/- within a period of four weeks from that date. When the matter is taken up for consideration, learned counsel for the petitioners submitted that subsequently the entire amount was paid and the loan was cleared and the matter was settled out of Court, hence, nothing survives for adjudication in the Writ Petition and the matter has become infructuous.

Recording the said submission, the Writ Petition is dismissed as infructuous. There shall be no order as to costs. As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
