HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 19412 of 2002 ORDER:

When this matter is taken up for hearing, it has been submitted by the learned Counsel for the petitioner that the petitioner was appointed as temporary messenger on 3.9.1984 in the 2nd respondent-Bank and he was continued with breaks and thereafter, he was interviewed for the post of regular messenger on 4.8.1989, and he was found successful in the said selections and he was empanelled, but his case was not considered for regularization of his services and in those set of circumstances the petitioner raised a dispute before the conciliation officer seeking a direction to the respondents to absorb him on regular basis.

He further contended that the Conciliation Officer conducted series of meetings and on failure of conciliation talks, he referred the failure report to the appropriate Government, and the Government referred the dispute to the Industrial Tribunal under Section 10(1)(d) of the Industrial Disputes Act and that the Tribunal has considered the case of the petitioner and declined to grant relief to the petitioner vide award dated 31.12.1999, and challenging the same, petitioner filed this writ petition.

The learned Counsel for the petitioner further contended that appropriate orders be passed directing the 2nd respondent to reinstate the petitioner with consequential benefits.

The learned Standing Counsel for the 2nd respondentBank submitted that the Tribunal has rightly dismissed the I.D. filed by the petitioner and that there are no merits in this writ petition.

This Court having considered the submissions made by the parties is of the view that the case of the petitioner was rightly dismissed by the Tribunal and that the petitioner could not point out any illegality or irregularity in the award passed by the Tribunal. In the absence of the same, this Court cannot interfere with the award passed by the Tribunal. 4.

Accordingly, the Writ Petition is dismissed. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
