Tekula Narsi Reddy , Venkat Reddy And 3 Others v. State Of Telangana

SMT JUSTICE T.RAJANI CRIMINAL PETITION NO.1417 OF 2018 ORDER:

This Criminal Petition is filed seeking for grant of anticipatory bail to the petitioners, who are A1 to A4 in Crime No.245 of 2017 on the file of the Station House Officer, Paloncha Town Police Station, Bhadradri Kothagudem District. The offences alleged are under Sections 290 and 307 read with Section 34 of the Indian Penal Code.

Heard the learned counsel for the petitioners/A-1 to A-4, learned Public Prosecutor appearing for the respondent-State, and perused the record.

Counsel for the petitioners does not press the Criminal Petition for petitioners 2 to 4/accused Nos.2 to 4, on the ground that they were already arrested.

He states, with regard to the first petitioner/A-1 that, earlier complaint was given against the husband of the de facto complainant by one worker in their hotel that he had outraged her modesty. As a counter-blast, this complaint is given against the petitioner and others. But in the report, the allegation is that the leg of the husband of the de facto complainant was broken in the said scuffle. This shows the occurrence of the incident. Learned Public Prosecutor submits that earlier Criminal Petition No.10792 of 2017 was filed by the first petitioner-A1 seeking for anticipatory bail and this Court, by order dated 15.11.2017, dismissed the said petition.

Hence, considering the above facts, this Court opines that it is not a fit case for grant of anticipatory bail to the petitioner-A1.

However, the petitioner-A1 can surrender before the Court concerned and seek regular bail. On such surrender, the concerned Court is directed to consider the bail application of the petitioner-A1 on merits and in accordance with law, on the same day subject to the regular pressure of work.

With the above observation, this Criminal Petition is dismissed. Miscellaneous petitions, if any, pending shall stand dismissed.
