HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2961 of 2016 ORDER:

This Criminal Petition, under Section 482 Cr.P.C., is filed by the petitioner-accused seeking to quash the proceedings in CC No.290 of 2009 on the file of Additional Judicial Magistrate of First Class, Tuni, East Godavari District.

The offence alleged against the petitioner is punishable under Section 138 IPC. Admittedly, after duly investigating into the case, police filed the charge sheet against the petitioner. Hence, this Court is not inclined to interfere with the proceedings against the petitioner.

It is submitted by the learned counsel for the petitioner that the learned Magistrate issued N.B.W. against petitioner while taking cognizance of the above said offences and that the petitioner is ready to face the trial and they will not flee from the hands of justice.

Having heard the learned counsel for the petitioner and the learned Additional Public Prosecutor and having perused the material available on record, this Court is of the view that this criminal petition can be disposed of with the following directions: The petitioner-accused is directed to appear before the Court concerned and file a petition to recall the warrants issued against them and on such petition being filed, the trial Court is directed to recall the warrants on the same day on petitioner executing a personal bond for a sum of Rs.5,000/- (Rupees five thousand only) with one surety for a like sum and further the petitioner is directed to appear before the trial Court on all hearing

dates.

Accordingly, the Criminal Petition is disposed of.

Consequently, the Miscellaneous Petitions pending if any, shall stand closed.
