HONOURABLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.16619 of 2014 ORDER :

For the offences punishable under Section 498-A of IPC and also under Sections 3 and 4 of the Dowry Prohibition Act, the learned II Additional Judicial Magistrate of First Class, Madanapalli, Chittoor District took cognizance of the charge sheet and numbered the matter as C.C.No.762/2014. Now this petition is filed seeking quashment of the proceedings in C.C. No.762/2014.

2. Heard the learned counsel for petitioner, learned Public Prosecutor appearing for the first respondent-State and also Sri K.Mahadeva, learned counsel appearing for the second respondent.

3. On a perusal of the charge sheet allegations, this Court is of the view that this is not a fit case to quash the proceedings. On the other hand, the petitioner/A1 is given liberty to file discharge application before the trial Court. In such case, I am sure the trial Court will consider the application on merits and pass appropriate orders. Considering the employment of the petitioner/A1, his presence before the trial Court is dispensed with except on the occasions when his presence is required by the trial Court.

4. With the above observations, this Criminal Petition is dismissed.

As a sequel, miscellaneous petitions pending, if any, shall

stand closed.
