HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.3635 of 2016 ORDER:
The petitioner is a driver recruited on 21.11.1995 and his services were regularized with effect from 01.08.1996. It appears that he was unwell and took treatment in APSRTC Hospital, Tarnaka, for a period of five days. Thereafter, he claimed to have undergone treatment for his illness by applying the local medicines and therefore, he was unable to attend the duties. After recovery from the illness, he claimed to have reported to the Depot Manager, Narayanpet, Mahabubnagar District (3rd respondent) on 01.03.2011. He was neither admitted to duty nor informed about his status. Having waited for considerable time and having requested again and again he issued a legal notice on 11.09.2015. Alleging that even after issuance of legal notice, no response is given by the respondent-Corporation, this writ petition is filed.
2. When the matter is taken up learned counsel for the petitioner as well as learned Standing counsel representing the respondent-Corporation submits that the writ petition can be disposed of directing the 2nd respondent to pass order on the notice dated 11.09.2015.
3. Having regard to the said submissions, without expressing any opinion on merits, the writ petition is disposed of directing the Regional Manager (2nd respondent) to consider the notice issued on behalf of the petitioner on 11.09.2015 and pass orders, if
already no orders are passed or no decision is taken regarding the status of the petitioner as an employee of the respondent-Corporation. If a decision was already taken, the same should also be informed to the petitioner. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
