THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.35807 of 2016 ORDER:

The writ petition is filed by the petitioner seeking a writ of mandamus declaring the inaction on the part of the second respondent in registering the F.I.R., against the third respondent and others in pursuant to the complaint acknowledgement bearing No.U2023093163900074, dated 19.02.2016, of the petitioner under Sections 498-A, 420, 406 read with Section 34 IPC and Sections 3 and 4 of the Dowry Prohibition Act as arbitrary and illegal and consequently, to direct the second respondent to register the F.I.R., against the third respondent and others in the interest of justice. Heard and perused the material.

Learned counsel for the petitioner submits that though petitioner lodged a complaint, dated 19.02.2016 and that the same is acknowledged, the second respondent is not registering the case against the third respondent and others and as such, he prays this Court to direct the second respondent to register the complaint and take action against the third respondent and others. Considering the facts and circumstances of the case, the writ petition is disposed of with a direction to the first respondent to register the complaint of the petitioner and conduct effective investigation and file final report, if any, in accordance with law.
