THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITIION No.3959 of 2018 ORDER:

Heard learned counsel for the petitioner and the learned Government Pleader for Home (A.P.).

According to the petitioner, he is a permanent resident of Balajinagar, Old Guntur. Earlier, a crime was registered against him, showing him as A4, on the file of the Police Station, Old Guntur, under Sections 302, 307 and 378 r/w 34 IPC, and the same was tried as S.C.No.13/2016 on the file of the learned Judge, Family Court-cum-XII Additional Sessions Judge, Guntur.

It is submitted by the learned counsel for the petitioner that the above said criminal case ended in acquittal on 07.06.2017. It is further submitted that, pursuant to the registration of the above said crime, police opened rowdy sheet against the petitioner herein on the file of the fourth respondent herein in the year 2012 and the same is being continued. It is further stated that no other criminal case is registered against the petitioner herein. Eventually it is submitted by the learned counsel for the petitioner that, in view of the above, further continuation of the rowdy sheet against the petitioner herein is impermissible in view of the Police Standing Orders and the said action is arbitrary and violative of

Article 21 of the Constitution of India besides being opposed to the very spirit and object of the Police Standing Orders. Having heard the learned counsel for the petitioner and the learned Government Pleader, this Court deems it appropriate to dispose of the Writ Petition, keeping it open for the petitioner to make an application before the third respondent, for redressal of his grievance, within a period of two weeks from the date of receipt of a copy of this order, and, if any such application is filed within the time stipulated, the same be considered and appropriate orders be passed, strictly in accordance with law, within a period of three months from the date of filing of such application. Accordingly, Writ Petition is disposed of.
