The case of the petitioners is that they have filed application dt.04.08.2017 in proceedings No.G/2380/2017 before respondent No.3 - Revenue Divisional Officer, Mancherial Division, for grant of Occupancy Rights Certificate in respect of the land admeasuring to an extent of Acs.11.28 guntas in Sy.No.484, and an extent of Acs.8.28 guntas in Sy.No.486 of Garimella Shivar, Mancherial Mandal and District, in terms of the provisions of Inam Abolition Act, 1956. Respondent No.3 called for a report from respondent No.4 - Tahsildar, Mancherial Mandal, who inturn submitted a report vide letter dt.05.01.2018. Inspite of receiving report from respondent No.4, as no orders are passed on their application till date, the petitioners have filed the present writ petition.
Heard learned counsel for the petitioners and the learned Assistant Government Pleader for Revenue. The only relief sought in this writ petition is nondisposal of application dt.04.08.2017 made by the petitioners for grant of Occupancy Rights Certificate in respect of the subject lands by respondent No.3, inspite of receiving a report from respondent No.4.
ARR,J W.P.No.4919 of 2020 Having regard to the facts and circumstances of the case, this writ petition is disposed of directing respondent No.3 to consider the application dt.04.08.2017 made by the petitioners for grant of Occupancy Rights Certificate in respect of the subject lands basing on the report submitted by respondent No.4 and dispose of the same by taking appropriate action in accordance with law, within a period of three (3) months from the date of receipt of a copy of this order. No order as to costs.
As a sequel, miscellaneous applications pending, if any, shall stand closed.
