THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.4194 of 2018 O R D E R:

This writ is filed challenging the action of respondent No.2District Collector (Panchayat Wing), Badradri Kothagudem, Telangana in not closing/dropping the proposed action of recovery of the amount from the petitioner by considering her explanation, dated 13.12.2017, pursuant to the show cause notice, dated 28.11.2017.

When the matter is taken up for hearing, learned Government Pleader for Panchayat Raj placed on record a copy of the order, dated 11.01.2018, passed by respondent No.2 pursuant to the aforesaid show cause notice, to the effect that the petitioner and Sri Devaraj, former Panchayat Secretary had misappropriated the amounts to an extent of Rs.9,55,409/- of the Gram Panchayat and hence, the said amount should be recovered from them. He furnished a copy of the same to the learned counsel for the petitioner.

In the light of the above, the relief prayed for cannot be granted in the writ petition.

Hence, the petition is closed giving liberty to the petitioner to avail the remedies, in accordance with law. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs. _________________________ CHALLA KODANDA RAM, J Dt:14.02.2018 kdl
