Heard.
The petitioner sought a Family Certificate for herself on account of death of her husband, Gorli Dinakara Babu. The Tahsildar, Anakapalli Mandal, Visakhapatnam, the 3rd respondent, however, declined to grant such certificate under his impugned endorsement, dated 23.10.2012, on the ground that the mother of the deceased, as well as unmarried brother and sister, have not given consent for the same.
Learned counsel for the petitioner, however, submits that the petitioner has no objection, if the 3rd respondent considers granting of Family Certificate in the name of the entire family, including herself, and it is not as if she alone seeks the Family Certificate in her name. If that be so, it is open for the petitioner to make a fresh application giving the details of the persons left behind by the deceased and seek appropriate Family Certificate and if such an application is made by the petitioner, the impugned endorsement shall not come in the way of consideration of such fresh application by the 3rd respondent, who shall examine the same and pass appropriate orders in accordance with law, expeditiously. The Writ Petition is accordingly disposed of. There shall be no order as to costs.
Miscellaneous Petitions, if any, pending in this Writ Petition
shall stand closed.
