THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.32574 of 2015 ORDER:

The petitioner was appointed as a permanent Fair Price Shop dealer of Shop No.23, Molagavalli Village, Alur Mandal, Kurnool District. The authorisation of the petitioner is valid upto 31.03.2016. While so, pursuant to the inspection conducted by the Assistant Supply Officer and on the basis of the report submitted by him on 10.03.2015, disciplinary proceedings were taken against the petitioner and an order of cancellation of authorisation was passed on 10.09.2015. Challenging the same, the present writ petition is filed. This Court has carefully perused the charges levelled against the petitioner along with the explanation and the findings recorded thereon. Though some of the charges are technical in nature, the other charges require an enquiry and the same cannot be done in proceedings under Article 226 of the Constitution of India.

Since the petitioner has already filed an appeal to the second respondent, the second respondent is directed to conduct an enquiry in respect of the charges as per the grounds of appeal by giving due opportunity to the petitioner and complete the same within a period of three (3) months from the date of receipt of a copy of this order.

Accordingly, this Writ Petition is disposed of. There shall be no order as to costs.
