SMT JUSTICE T.RAJANI CRIMINAL PETITION No.1431 OF 2018 ORDER:

This petition is filed seeking for grant of anticipatory bail to the petitioner, who is A18, in Crime No.639 of 2016 on the file of Vanasthalipuram Police Station, Cyberabad. The offences alleged are under Sections 506 and 509 IPC and Sections 120(B), 384 IPC and Section 25(1-B)(a), 27 Arms Act. 2.

Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.

The public prosecutor brings to the notice of this Court the orders of this Court passed in Crl.P.No.11555 of 2017, by virtue of which, this Court dismissed the petition which was filed seeking for grant of anticipatory bail. The counsel for the petitioner submits that there was an observation by the Court that the petitioner was absconding and was disabling the police to file charge sheet and since, now, the charge sheet is filed and a direction may be given for him to surrender before the court and obtain regular bail. 4.

Hence, in the circumstances, in which the earlier petition filed by the petitioner seeking for grant of anticipatory bail is dismissed on merits and that an observation that petitioner is not enabling the police to file charge sheet by absconding himself, this Court is inclined to dismiss the petition, but the petitioner is at liberty to surrender before the court and obtain regular bail. The court below shall dispose

of the bail application on merits, if any filed, expeditiously, preferably on the same day, subject to the pressure of other work.
