THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.4833 of 2019 ORDER:

This writ petition is filed challenging the action of the respondents in not granting full pension, gratuity, commuted value of pension and other retirement benefits to the petitioner for want of finalization of disciplinary case pending against him vide Memo dated 29.10.1999 and in making inordinate delay in finalization of the disciplinary proceedings.

When the matter is listed on 11.03.2019 learned counsel for the petitioner on instructions from his client, agreed that the petitioner would be content if the respondents impose punishment of 10% cut in pension for a period of ten years and having regard to the said statement, this Court directed the Principal Secretary to Government, Revenue Department to offer his view on the aforesaid proposal of the petitioner and directed to post the matter on this day i.e. 25.03.2019. When the matter is listed to-day i.e. 25.03.2019, learned Government Pleader for Revenue produced a copy of G.O.Rt.No.83, Revenue (vigilance.I) Department, dated 23.03.2019, wherein the respondents have imposed the punishment of 10% cut in pension for a period of ten years against the petitioner.

Having regard to the aforesaid G.O.Rt.No.83, dated 23.03.2019 whereby the respondents have passed orders in the disciplinary case

pending against the petitioner, this Court is of the considered view that the cause in the writ petition no longer survives for adjudication and the same is liable to be closed.

Accordingly, the writ petition is closed. However, it is made clear that the respondents shall release the pension and other retirement benefits of the petitioner by duly taking into account the punishment orders issued in G.O.Rt.No.83, dated 23.03.2019, within a period of four weeks from the date of receipt of a copy of this order. No order as to costs.

As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed.
