HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.4797 of 2019 ORDER:
The prayer of the petitioner in this case reads as under:- "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus declaring the inaction of the Respondents in mutating the lands in Sy.Nos.12, 54, 155, 156, 157, 160 etc with kasha Number 9014 of Solipur village and the lands in Sy.Nos.142, 143, 203, 210, 213, and etc with Khata Number 189 of Ankushapur village of late Muddasani Narayana Reddy as illegal, arbitrary, and contrary to the provisions of Record of Rights in Land and Pattedar Pass Books Act 1971 and consequently direct he Respondents to mutate the lands of late Muddasani Narayana Reddy in favour of the Petitioner and other legal heirs and to pass such other order or orders as this Honourable Court may deem fit and proper in the facts and circumstances of the case."
The petitioner claims rights over the subject lands as the grandson of late Muddasani Narayana Reddy.
Perusal of the record reflects that the petitioner did not make an application in the prescribed format in Form VIA as required by Section 4 of the Telangana Rights in Land and Pattadar Passbooks Act, 1971, read with Rule 18(2) of the Telangana Rights in Land and Pattadar Passbooks Rules, 1989. He seems to have merely submitted his objections to the draft Form IB issued by the Tahsildar, Tarigoppula Mandal, Jangaon District. Without making an application in the prescribed format, it is not open to the petitioner to complain of inaction on the part of the revenue authorities in carrying out the mutation in his favour. The Writ Petition is accordingly disposed of permitting the petitioner to make an application in the prescribed format in
SK, J WP.No.4797 of 2019 Dt:08.3.2019 Form VIA along with the requisite fee. In the event such an application is made, the Tahsildar, Tarigoppula Mandal, Jangaon District, shall take appropriate action thereon expeditiously and in any event, not later than four weeks from the date of receipt of the application.
