THE HON'BLE SRI JUSTICE DILIP B.BHOSALE CIVIL REVISION PETITION No. 4009 of 2011 P.C:

This C.R.P. is against the order, dated 12.10.2010 passed on an application, being I.A.No.253 of 2010 in O.S.No.46 of 2010 passed by the A.P. State Wakf Tribunal, Hyderabad. By the impugned order, application filed by the petitioners under Order 39 Rules 1 and 2 of the Code of Civil Procedure came to be rejected. It is apparent that four years have passed after the impugned order and that this Court at no point of time, granted any relief in favour of the petitioners. In view thereof, learned counsel for the petitioners fairly states that Tribunal may be directed to dispose of the O.S. itself on merits in accordance with law expeditiously.

C.R.P. is dismissed. The Tribunal shall decide O.S.No.46 of 2010 expeditiously on merits in accordance with law and uninfluenced by the order passed on the application under Order 39 Rules 1 and 2 of the Code of Civil Procedure. All contentions on merits are kept open.

Consequently, miscellaneous petitions, if any, also stand disposed of.
