THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.4055 of 2018 ORDER:

Petitioner challenges the notification issued in 2016 proposing to appoint permanent dealer in respect of fair price shop of Rami Reddy Layout, Madanapalle Urban, Chittoor District, on the ground that the same is issued in violation of the guidelines mentioned in G.O.Ms.No.35, dated 17.09.2007, which mandate that two shops shall not be existed within one kilometer radius.

Considering the fact that the petitioner has come to the Court challenging the notification, dated 21.06.2016, in 2018, interests of justice would be served, if a direction is issued to the respondents to ensure that the guidelines mentioned in G.O.Ms.No.35, dated 17.09.2007, are adhered to particularly, in relation to maintaining distance between the two fair price shops. The Writ Petition is accordingly, disposed of. Miscellaneous Petitions, if any pending shall stand disposed of.
