HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.27469 OF 2009 ORDER:

This petition is filed for a writ of Mandamus declaring the actionof the 2nd respondent in issuing eviction notice No.A1/2024/08, dated 02.12.2009 and the auction notice dated 02.12.2009 in respect of Municipal Shop No.6 at N.H.9, Main Road, Sadasivapeta Town, Medak District, as illegal and arbitrary and to set aside the same and for a consequential direction to the 2nd respondent to permit the petitioner to continue as tenant in respect of the said shop.

This Court on 16.12.2009 granted Interim Stay of eviction of the petitioner from the shop concerned for four weeks and also directed the respondents to proceed with the auction of leasehold rights and that the petitioner shall be entitled to participate in the auction.

Sri N.Praveen Kumar, learned counsel appearing for the 2nd respondent, on instructions, submits that in pursuance to the interim direction passed by this Court, the petitioner participated in the tender process and also declared as successful bidder and that he is continuing. As such, the cause in the writ petition does not survive for adjudication.

Recording the aforesaid submission made by the learned counsel, the writ petition is dismissed as infructuous. No order as to costs.

As a sequel to the dismissal of the writ petition, Interim
