THE HONOURABLE SMT JUSTICE K. SUJANA CRIMINAL PETITION No.2308 of 2025 ORDER:
Seeking the Court to enlarge the petitioner, who is arrayed as accused No.7 in Crime No.64 of 2025 of KUC Police Station, Warangal District, on pre-arrest bail, the present Criminal Petition is filed.

The brief facts of the case are that the case involves Katkuri Chandu @ Sunny, a 29-year-old private employee, who loved Jupaka Sindhuja. The two families had agreed to their marriage, but the accused persons later changed their minds and started harassing Chandu, warning him not to pursue the relationship. Due to unbearable harassment, Chandu consumed poison and recorded a selfie video before his death at Medicover Hospital, Hanamkonda. The incident occurred on February 3, 2025, and was reported by Chandu's mother, Katkuri Annapurna, on February 4, 2025. 3.

Mamoon, learned Additional Public Prosecutor appearing on behalf of the respondent-State.

Learned counsel for the petitioner submitted that the petitioner is innocent and falsely implicated in the crime, with no specific overt acts attributed to him. The implication of the petitioner is based on a general allegation against all accused, and the petitioner has no connection with the Jupaka family, suggesting an ulterior motive. The case of the prosecution involves a one-sided love affair between the deceased and Jupaka Sindhuja (A-2), which led to the deceased's suicide after receiving threatening warnings. However, since Jupaka Sindhuja is an accused, the offense under Section 108 may not apply. Therefore, he prayed the Court to grant pre-arrest bail to the petitioner by allowing this criminal petition. 5.
On the other hand, learned Additional Public Prosecutor vehemently opposed the submissions made by learned counsel for petitioner, stating that the allegations leveled against the petitioner are serious in nature. At this stage, granting of pre-arrest bail to the petitioner does not arise.
Therefore, he prayed the Court to dismiss the Criminal Petition.

After considering the submissions made by both the learned counsel and reviewing the material available on record, it appears that except mentioning the name of the petitioner, there are no specific overt acts against him. Considering the facts and circumstances of the case, as the material part of the investigation is completed, this Court deems it fit to grant pre-arrest bail to the petitioner subject to the following conditions:
i.
The petitioner shall surrender before the Station House Officer, KUC Police Station, Warangal District, within two weeks from today, and on such surrender, the said Station House Officer shall release him on bail on executing a personal bond for Rs.25,000/- with two sureties, for the like sum each.
ii.
The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, and co-operate with the Investigating Officer in investigating the case.
iii.
The petitioner shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., till the filing of the charge sheet and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
