HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.42627 of 2016 ORDER:
This writ petition is filed seeking to declare the action of the 3rd respondent in threatening to dispossess the petitioners herein from the land admeasuring Acs.10.94 cents situated at Padmanabharajupeta village, Yelamanchli Mandal, Visakhapatnam District, and consequently, direct the 3rd respondent not to dispossess the petitioners from the above land.
Heard and perused the material available on record. The case of the petitioners is that they are absolute owners and possessors of the subject land and that the unofficial respondents i.e. respondents 4 to 7 are interfering with their peaceful possession and enjoyment over the subject land and at their instigation, the 3rd respondent is threatening the petitioners to dispossess from the said land.
Learned Assistant Government Pleader for Home submitted that the respondent police are not intending to interfere with the civil disputes.
Considering the circumstances of the case, without expressing any opinion on merits, the Writ Petition is disposed of with the following direction:
" The 3rd respondent is directed not to interfere with the affairs of the petitioners and the respondents 4 to 7, more particularly, with the civil disputes pending between them. However, this order will not stand in the way of the
3rd respondent to register a case, if any complaint is lodged against the petitioners for cognizable offence." There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. ______________ RAJA ELANGO, J December 07, 2016.
