HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.16451 OF 2017 ORDER:

The writ petition is filed by the petitioner against the order dated 21.04.2017, passed by the Deputy Commissioner of Prohibition and Excise, Warangal, rejecting release of white jaggery.

Petitioner states that, during the course of business, he purchased 500 Kgs. of jaggery from Annaj and Jaggery General at Warangal under bill No.101 dated 03.04.2017. Respondent No.3, intercepted the vehicle and, seized the stock as well vehicle loaded with stock and registered a case in C.O.R.No.58 of 2017. By the impugned order, respondent No.2 rejected the petitioner's application for release of white jaggery.

Heard the learned counsel for the petitioner and the learned Government Pleader for Prohibition and Excise (TG). In the facts of the present case and, considering the fact that the petitioner was carrying on business in white jaggery, which is fit for human consumption, and having purchased jaggery, under bill dated 03.04.2017 from Annaj and General, Warangal, for Sriramanavami Festival, the seized goods shall be released in favour of the petitioner by respondent No.2 on furnishing a Fixed Deposit Receipt for a sum of Rs.5,000 (Rupees Five Thousand Only) in his favour. It is, however, made clear that release of the stock shall be

subject to the final orders that may be passed in C.O.R.No.58 of 2017.

The Writ Petition is disposed of accordingly. Miscellaneous Petitions pending, if any, in this writ petition shall stand closed. No order as to costs. ______________________________ CHALLA KODANDA RAM,J Date:28.04.2017.
