HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:

Petitioner, who is the General Power of Attorney, claims that Sri K.Ram Mohan Reddy is the owner of open plot to an extent of 593 square yards in Sy.Nos.157 to 162, 175, 176 and 177/A of Suraram village, Quthubullahpur Mandal, Ranga Reddy district. There appears to be a dispute between K.Ram Mohan Reddy and Kiran Appala (6th respondent). Petitioner alleges that Police are interfering in civil disputes between the petitioner and the 6th respondent. Learned counsel for petitioner contends that, alleging 6th respondent is trying to trespass by demolishing the compound wall, K.Ram Mohan Reddy lodged complaint on 22.01.2019. This complaint was not registered. On the other hand, based on the complaint filed by the 6th respondent, crime is registered as FIR No.121/2019 on 22.02.2019 in Dundigal Police Station and in the guise of registering crime, Police are interfering in civil disputes. 2.

A bare look at the complaint made by the 6th respondent would show that he alleges that Ram Mohan Reddy, Chandra Seheker i.e., petitioner herein, and another illegally trespassed into their house plot and constructed one room. Since the allegation is illegal trespass, it cannot be said that Police cannot visit the scene of offence to ascertain true facts, and merely because Police are visiting the scene of offence, it cannot be said that they are interfering in civil disputes.

It is appropriate to note that petitioner is not challenging the registration of criminal case nor is his grievance in the writ petition that complaint made on 22.1.2019 is not registered. Without

expressing any opinion on merits on registration of crime at the instance of 6th respondent and non-registration of crime filed by the petitioner, Writ Petition is dismissed, leaving it open to petitioner to work out his remedy as available in law. Pending miscellaneous petitions shall stand closed.
