THE HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.1241 OF 2015 ORDER:
This writ petition is filed by the petitioner seeking a direction to the respondent Nos.2 to 6 to take steps for conducting the survey and fixing the boundaries to the Government lands, SRSP lands, link roads and cart ways as per Village Bandobast Map, which is available with the 4th respondent considering the representation submitted by the petitioner dated 19.04.2014, the memo issued by the 4th respondent dated 14.07.2014 and the letter addressed by the 5th respondent dated 26.7.2014 to enable to take up the developmental works in Eedulagattepally Village, Manakondur Mandal as per the resolution of Grama Sabha and works approved by the 7th respondent.
It is the case of the petitioner that she is a Sarpanch of Edulagattepally Village; that she is taking up the developmental activities in the village as per the scheme formulated by the Central Government under Mahatma Gandhi National Rural Employment Guarantee Scheme and the same was supervised and implemented by the respondent Nos.2 to 7 in Karimnagar District. It is the further case of the petitioner that for implementation of the said scheme, it is necessary to survey and demarcate the existing cart tracks and the boundary of the public tanks and also fix the boundary to the Government lands, as per the village Bando Basth Naksha and as such, the petitioner submitted representations to the respondent Nos. 2 to 6 on 19.04.2014 and 28.10.

It is further stated that pursuant to the representations of the petitioner, the 4th respondent issued a memo to the Mandal Surveyor on 14.07.
instructing him to show the boundaries of Government lands for taking steps to establish a dump yard, grave yard, drinking water well, flood flow canal and other village development activities under employment guarantee scheme within a period of 3 days and submit a report. On 26.7.2014, the 5th respondent had also addressed a letter instructing the Mandal Surveyor of Manakondur Mandal and another Surveyor of Head Quarter to conduct the survey and demarcate to fix the boundary under the supervision of the Deputy Inspector Survey, Karimnagar Division and Inspector of Survey, Karimnagar and asked for report in 7 days.
A perusal of the record reveals that proceedings on paper have been issued, but nothing has been done either by the 5th respondent or by his subordinates. Hence, this writ petition. When the matter has come up for admission on 29.01.2015, the learned Assistant Government Pleader for Revenue was directed to get the instructions in the matter. Today, the learned Assistant Government Pleader for Revenue submits that in spite of his intimation to the respondents, the respondents failed to appraise him of the facts. However, he submits that the writ petition may be disposed of with a direction to the respondents to complete the survey as ordered by the 5th respondent in a time bound manner.
Having regard to the facts and circumstances of the case and especially in view of the limited relief sought by the petitioner, the interest of justice would be served, if a direction is given to the 5th respondent to ensure completion of survey and demarcation to be made within a period of 3 months from today.
With the above observations, the writ petition is disposed of. There shall be no order as to costs. Miscellaneous Petitions, pending if any in this writ petition, shall stand closed.
