HONOURABLE SRI JUSTICE RAJA ELANGO Criminal Petition No.8650 of 2015 ORDER:

This criminal petition is filed by the petitioner/accused, under sections 437 and 439 Cr.P.C., seeking bail in Crime No.88 of 2015 of Kasimkota Police Station, Visakhapatnam District, registered for the offence punishable under Section 20(b) of NDPS Act.

The brief case of the prosecution is that on 17-062015, the Respondent-Police, on credible information, came t o Thallapalem Junction and while conducting vehicle checking, Driver of a passenger Auto No.AP 31 Y 1351 who was proceeding towards Narsipatnam side, on seeing the Respondent-Police, tried to escape, but the RespondentPolice could apprehend him and found 54 Kgs. of ganja. As the quantity of ganja seized from the petitioner - accused is 54 Kgs., which is commercial quantity, this Court is not inclined to grant bail to the petitioner - accused at this stage.
