2017-10-05A.Rajasheker Reddy2 pages

HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.31898 OF 2017 ORDER:

This writ petition is filed challenging the proceedings dated 18.06.2017 issued by the 3rd respondent removing the petitioner from service. Heard learned counsel for the petitioner.

Learned Assistant Government Pleader for Panchayat Raj seeks time.

A reading of the impugned proceedings goes to show that though the petitioner submitted explanation, without considering the same in proper perspective and without assigning the reasons the 3rd respondent passed impugned proceedings by simply stating that the explanation submitted by the petitioner is not satisfactory, which is in violation of principles of natural justice.

Having regard to the fact that the impugned order is passed without giving any reasons, this Court, without expressing any opinion on merits, disposes the writ petition by setting aside the impugned order dated 18.06.2017 only on the ground of violation of principles

of natural justice and remits the matter back to the authorities for fresh disposal.

The writ petition is allowed to the extent indicated above. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 05.10.2017 tk
