This criminal petition is filed under Section 482 Cr.P.C. seeking to quash the proceedings in C.C.No.1/2010 on the file of Metropolitan Magistrate, Visakhapatnam City, registered against the petitioners/accused 18 and 22 for the alleged offences punishable under Section 406, 420 read with 34 IPC and Section 5 of A.P. Protection of Depositors of Financial Establishment Act, 1999.
Heard the learned counsel for the petitioners and the learned Public Prosecutor appearing for the State.
A perusal of the material on record reveals that specific allegations were made against the petitioners. The truth or otherwise of the allegations can only be decided during course of trial. I see no ground to interdict at this stage and quash the proceedings.
In the facts and circumstances of the case and as requested by the learned counsel for the petitioners, the criminal petition is disposed of, directing the trial court to dispose of the case as expeditiously as possible, preferably within a period of six months from the date of receipt of a copy of this court, without insisting the presence of the petitioners 18 and 22, unless required for any specific purpose.
