CVNR,J & DVSS,J LLAS.Nos45, 108 and 109. of 2015 COMMON JUDGMENT: (Per the Hon'ble Sri Justice C.V.Nagarjuna Reddy) These three Appeals arise out of common judgment and decree, dated 30.06.2007, to the extent they relate to OP.Nos.198, 199 and 203 of 1995 respectively, on the file of the Principal Senior Civil Judge, Ranga Reddy District.

At the hearing, the learned counsel for the appellants submitted that in respect of the lands situated adjacent to the lands covered by these appeals, the market value of Rs.38,720/- as fixed by the Land Acquisition Officer was enhanced by the reference Court to Rs.58,080/- and that in LAAS.No.851 of 2006 filed by the claimants therein against OP.No.202 of 1995, the market value was further enhanced to Rs.1,25,000/- (Rupees one lakh and twenty five thousand only ) per acre.

The learned Government Pleader for Appeals (T.S.) has fairly conceded that the lands involved in these appeals have similar potentiality and are also situated adjacent to the lands in respect of which the market value has been enhanced to Rs.1,25,000/- in LAAS.No.851 of 2006. He has, however, submitted that as these appeals have been filed with a delay of nearly seven years, the appellants are not entitled to interest during the period of delay and that the same may be specifically incorporated in the order. The learned counsel for the appellants has fairly conceded this request.

In the light of the above discussion, these appeals are partly allowed by enhancing the market value of the lands to Rs.1,25,000/- (Rupees one lakh and twenty five thousand only) per acre with all statutory benefits except to the extent that the appellants are not entitled to interest for the period of delay i.e. 2592, 2591 and 2631 days respectively in filing these appeals.

The appeals are, accordingly, partly allowed to the extent indicated above.
