THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.3350 OF 2017 O R D E R :

Petitioner had filed this Writ Petition challenging proceedings dt.16.01.2017 of 2nd respondent transferring the petitioner from ROP Tandur to RPS Khammam.

Counsel for the petitioner contends that transferring the petitioner in the middle of the academic year on the pretext of administrative necessity is not warranted and it amounts to abuse of power. He relied upon the orders of transfer made on 20.01.2007 issued by the 2nd respondent stating in those orders it was stated that if any employee wants to stay back until his children's academic year is completed, he should be allowed to continue till the end of the academic year. He contends that this has been done in the middle of the academic year and it causes hardship to the petitioner, whose children and relatives are studying in Hyderabad, where the petitioner is presently employed.

3. The Government Pleader for Home appearing for respondents states that in W.P.Nos.2189 of 2017 and 2191 of 2017 this Court has permitted the petitioners therein to make a representation to the 2nd respondent for retention at the existing place of work till the completion of the academic

years of their children and pending consideration of the said representation, directed that the transfer order be not given affect to.

In view of the said submissions, this Writ Petition is disposed of directing the petitioner to make a representation to the 2nd respondent for retaining him in ROP Tandur till the end of the academic year, within one week from the date of receipt of a copy of this order, and on receipt of said representation, the 2nd respondent shall consider the same in accordance with law and communicate his decision thereon to the petitioner. Till the decision of the 2nd respondent is communicated to the petitioner, the impugned order shall not be given affect to. There shall be no order as to costs. 5.

Consequently, miscellaneous petitions pending if any, shall stand closed.
