HONOURABLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.1191 OF 2017 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Cr.P.C. to enlarge the petitioner on bail in Crime No.850 of 2016 of Jawaharnagar Police Station, Ranga Reddy District, registered for the alleged offences punishable under Sections 302 and 498-A of I.P.C. Petitioner is in judicial custody since 2-12-2016. The case of the prosecution, in brief, is as follows: Petitioner allegedly committed murder of his wife while subjecting her to cruelty on 1.12.2016 at 6.30 P.M. Their marriage was performed at about 11 years ago and they were blessed with two children but the petitioner subjected his wife to cruelty and he addicted to vices and on account of such unbearable harassment, she went into psychological depression and thereafter, she was murdered by her husband i.e., petitioner herein.

The main contention of the petitioner is that she is suffering from heart ailment and she was treated while in jail due to her problems but no piece of evidence was brought on record to establish that she was suffering from heart ailment, as on today, except the argument he advanced before this court.

MSM,J Crl.p_1191 of 2017 material to conclude that the petitioner murdered his wife subjecting her to cruelty and hence, it is not a fit case to enlarge the petitioner on bail at this stage and as such, this petition is liable to be dismissed. In the result, this Criminal Petition is dismissed.
