HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 4824 of 2019 ORDER:
The prayer of the petitioner in this case reads as under: "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus declaring the action of the respondents particularly the 2nd respondent herein in not conducting survey and demarcation of the land under Sy.No.229 situated at Malkajgiri Village and Mandal, Medchal-Malkajgiri District on the application of the petitioner dated 10.01.2019 as illegal, arbitrary, unjust and violation of principles of natural justice and against the provisions of AP Survey and Boundaries Act 1923 and the Rules made thereunder and consequently direct the respondents 2 and 3 to conduct survey and demarcation and fix boundary stones surrounding the land admeasuring of Acs.2.09 gts under Sy.No.229 situated at Malkajgiri Village and Mandal, MedchalMalkajgiri District, and to pass such other order or orders as this Honourable Court may deem fit and proper in the facts and circumstances of the case."
Perusal of the record reflects that the petitioner submitted a mee-seva petition on 30.01.2019 seeking a survey of the subject land and fixing of boundaries thereon. Having received such an application, it is not open to the revenue authorities to remain somnolent.
The Writ Petition is accordingly disposed of directing the respondents to take appropriate action upon the petitioner's mee-seva petition dated 30.01.2019 for conducting a survey of the subject land and fixing of boundaries thereon. This exercise shall be completed expeditiously and in any event, not later than eight weeks from the date of receipt of a copy of this order, be it from whatever source.
