THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION Nos.2917, 2942, 2963 & 2968 OF 2017 COMMON ORDER :

Since the subject matter of these writ petitions is one and the same, all are heard together and disposed of by this common order.

In all these writ petitions, petitioner is challenging the impugned notice issued in Form I & II under Rule 3 of the Andhra Pradesh Assigned Lands (Prohibition of Transfers) Rules, 2007. The case of the petitioner is that earlier petitioner was issued notices under Rule 3 of the Andhra Pradesh Assigned Lands (Prohibition of Transfers) Rules, 2007 and she has filed explanation to the said notices and also filed W.P.Nos. 40210/2012, 40184/2012, 40104/2012 and 40151/2012. The said writ petitions are disposed of by this Court vide orders dated 03.01.2013 directing the respondent authorities to consider the explanation of the petitioner and pass orders. But the authorities without passing any further orders, again issued the fresh impugned notice vide No.B/2014/2016.

Learned counsel for the petitioner submits that having issued notices earlier, the respondents cannot once again issue similar notices.

Learned Assistant Government Pleader for Revenue basing on the counter affidavit submits that though notices were issued earlier and explanation is filed by the petitioner, no orders are passed on the same, due to misplacing of the files. As such, again fresh impugned notices were issued and as and when the

petitioner files explanation, the concerned authority will pass final orders.

In view of the above submission, it is open for the petitioner to submit explanation to the notice within four weeks and on such explanation being filed, the 5th respondent is directed to consider the explanation of the petitioner and pass final orders, within a period of eight (08) weeks from the date of receipt of copy of this order, after giving an opportunity of hearing to the petitioner. Till passing of final orders, there shall be stay of dispossession of the petitioner. If petitioner does not file explanation within above stated period, it is open for the 5th respondent to pass appropriate orders in accordance with law.

With the above direction, these writ petitions are disposed of No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in these Writ Petitions, shall stand closed.
