THE HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.8887 OF 2006 ORDER:

This Writ Petition is filed for the following relief: "......to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus declaring (i) the action of the 1st respondent in not accepting the payments from the petitioner and proceeding with the auction, (ii) the action of the 1st respondent in seeking to confirm the sale in favour of the 2nd respondent in respect of land admeasuring Ac.1-00 guntas situated in Sy.No.630 of Sampara Village, Pedhapudi Mandal, East Godavari District, pursuant to the auction notification dated 15.03.2006 as arbitrary, illegal and violative of Article 14 & 21 of the Constitution of India, (iii) consequently set aside the auction dt:15.03.2006 and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

When the matter is taken up for hearing, learned counsel for the 1st respondent-District Co-operative Central Bank, Ramachandrapuram Branch submits that the amounts which were due by the 3rd respondent to the 1st respondent were settled by the petitioner, in terms of the orders of this Court dated 28.04.2016 passed in W.P.M.P.No.11310 of 2006 in W.P.No.8887 of 2006, thereby no further orders as such are required to be passed in the writ petition.

Recording the submissions made by the learned counsel for the 1st respondent, this Writ Petition is closed. There shall be no order as to costs. Consequently, the Miscellaneous Petitions pending, if any, shall also stand closed.
