ORDER
Heard learned counsel for the petitioner and learned Government Pleader for Civil Supplies for respondents.
2. As per the affidavit filed by the petitioner, she was appointed as fair price shop dealer on permanent basis in the year 2010 by the 2nd respondent. Basing on the report of the 3rd respondent dated 27.07.2014, the 2nd respondent issued suspension-cum-show cause notice by framing 10 charges. Challenging the same, the petitioner filed W.P.No.24555 of 2014 and this Court set aside the said order directing the 2nd respondent to pass final order after giving due opportunity to the petitioner. The 2nd respondent thereupon issued a fresh show cause notice on 18.03.2015 framing 4 charges only and the petitioner submitted her explanation on 02.04.2015. Now, a final order is passed on 04.04.2015 suspending the authorization of the petitioner. Challenging the same, the present writ petition is filed.
3. Learned counsel for the petitioner submitted that the impugned order of suspension does not indicate the period of suspension.
4. However, a reading of the impugned order shows that an appeal is provided against the impugned order.
5. In the circumstances, the Writ Petition is disposed of, giving liberty to the petitioner to file an appeal before the appropriate authority within a period of 15
days from the date of receipt of a copy of this order and upon receipt of such appeal, the appellate authority shall consider the same and pass appropriate orders in accordance with law after giving due opportunity to the petitioner, within a period of two months thereafter. It is needless to mention that the order of suspension passed by the 2nd respondent shall be subject to the final order passed by the appellate authority.
6. The Writ Petition is, accordingly, disposed of. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. _________________________ A. RAMALINGESWAR RAO, J 1st June, 2015 sj
