2019-06-14Sanjay Kumar1 pages

HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.4840 of 2019 ORDER:

The grievance of the petitioner in this case was that the authorities were trying to dispossess him from the subject land without following the due procedure laid down by law.

By interim order dated 08.3.2019 granted in this Writ Petition, this Court directed that in the light of the documents placed on record in proof of the petitioner's possession over the subject land, the respondents should not interfere with her possession over the said land, even if warranted, except in accordance with the due procedure laid down by law.

Learned Assistant Government Pleader for Revenue, State of Telangana, states, on instructions, that as per his information, the subject land belongs to the Fisheries Department of the State. He however does not dispute the fact that the revenue records indicate the possession of the petitioner.

In that view of the matter, the Writ Petition is disposed of affirming the interim order dated 08.3.2019 and directing the respondent authorities not to interfere with the possession of the petitioner over the subject land except in accordance with the due procedure laid down by law.

Pending Miscellaneous Petitions, if any, shall stand closed in the light of this final order. No order as to costs. ________________________ JUSTICE SANJAY KUMAR 14th June, 2019 dr
